A: General Terms and Conditions (GTC) for the use of the NAHSHUTTLE app

1. Scope

These General Terms and Conditions (GTC) regulate the use of the NAHSHUTTLE app and the booking of trips via the platform. The provider is NAH.SH GmbH, Raiffeisenstrasse 1, 24103 Kiel. Transport is carried out by the contracted transport companies. The current partners of the NAHSHUTTLE offer are the District of Rendsburg-Eckernförde, the District of Schleswig-Flensburg, the District of Nordfriesland and the District of Ostholstein. Other partners may be added; a list of current partners can be found at www.nahshuttle.sh.

2. Purpose of the NAHSHUTTLE app 

The NAHSHUTTLE app is a booking platform for demand-driven transport as a supplement to public transport. The NAHSHUTTLE app can be used to book different types of transport in accordance with the Passenger Transport Act (PBefG). This includes on-demand transport in accordance with § 44 PBefG and call-line trips (ALFA transport), which are based on fixed routes and can also be booked by phone or via the NAHSHUTTLE app. The applicable transport and tariff conditions depend on the type of transport and the service area.

3. Registration and obligations

Registration is required for use. Users must provide truthful information (name, telephone number, email address). Fictional names are not permitted. Minors may only use the NAHSHUTTLE app with the consent of their parents or guardians, especially if a means of payment must be provided. We recommend use from the age of 6 years, in accordance with the conditions of carriage of public transport.

4. Conclusion of the contract

The transport contract is concluded as soon as the user confirms the travel offer via the booking option. The currently valid tariff provisions of the Schleswig-Holstein tariff and the conditions of carriage of Schleswig-Holstein public transport apply. Passengers are obliged to present a valid ticket (e.g. Deutschlandticket or NAHSHUTTLE ticket) immediately upon boarding. Transport may be refused without a valid ticket.

5. Payment terms

Payments must be made via SEPA direct debit, credit card or PayPal. The processing of payments is handled by LogPay Financial Services GmbH. Payment can also be made inside the vehicle: depending on the region, payment can be made by Girocard and/or in cash. By booking, the user assigns the claim to LogPay. Users must ensure sufficient coverage for payments.

6. Cancellation and fees

Depending on the region, cancellations can be made free of charge up to a certain point in time. Fees may apply for short-term cancellations or no-shows. Details of fees per region are listed in the FAQs.

7. Accuracy of content and provision of transport

NAH.SH GmbH assumes no liability for the accuracy, completeness and timeliness of the content displayed in the NAHSHUTTLE app. The main purpose of the NAHSHUTTLE app is to book an individual shuttle offer at the displayed conditions. NAH.SH GmbH provides the booking platform, but is not responsible for the provision of transport. Transport is provided by the relevant contracted transport companies. Claims for delay or cancellation must be directed to the relevant transport company.

8. Technical availability of the NAHSHUTTLE app and liability

The technical implementation of the NAHSHUTTLE app is carried out by ioki GmbH. NAH.SH GmbH, the project participants and ioki GmbH assume no liability or warranty for the smooth functioning of the NAHSHUTTLE app.

NAH.SH GmbH reserves the right to alter or discontinue the offer at any time. NAH.SH is entitled to alter the booking platform, the NAHSHUTTLE app or the service in any form at its own discretion without the consent of the person using the NAHSHUTTLE app, in particular with regard to further development, improvement or troubleshooting of the NAHSHUTTLE app and service.

NAH.SH GmbH is solely liable for the provision and functionality of the booking platform. The relevant transport company is liable for the provision of transport, including any delays or cancellations, in accordance with the applicable conditions of carriage.

NAH.SH GmbH as the provider of the NAHSHUTTLE app – regardless of the legal basis – is liable only if damage is caused by culpable violation of a contractual obligation in a way that jeopardizes the achievement of the purpose of the contract or is due to intent or gross negligence. The above exclusion of liability does not apply to culpable injury to life, limb and health and to liability claims under the Product Liability Act.

NAH.SH GmbH is not liable for damages resulting from impaired availability of the NAHSHUTTLE app, in the event of technical faults and events of force majeure which are beyond its control, as well as faults caused by third parties. However, NAH.SH GmbH will do everything possible to ensure the reliability and functionality of the NAHSHUTTLE app.

Furthermore, NAH.SH GmbH provides no guarantee that it will be possible to install the NAHSHUTTLE app on the participant’s end device and that it will function properly. There is no entitlement to the use of the NAHSHUTTLE app. The app is available in versions for the Android and iOS operating systems.

9. Conditions of carriage

Hand luggage, prams and wheelchairs are permitted, provided that safety is not compromised. Dangerous items are excluded. For safety reasons, e-scooters and e-pedal scooters are not permitted. Dogs must be kept on a leash; dangerous dogs must be muzzled.

10. Exclusion from transport

Persons who pose a threat to safety may be excluded from transport. Children under the age of 6 who are not of school age may be excluded from transport unless they are accompanied throughout the entire journey by persons who are at least 6 years of age. Sentence 1 remains unaffected.

11. Data protection

Personal data is processed in accordance with the privacy policy at https://www.nahshuttle.sh/en/privacy-policy/. Users can revoke their consent at any time. It will no longer be possible to use the NAHSHUTTLE app after consent has been revoked.

12. Changes to the GTC

NAH.SH GmbH may amend these GTC. Users will be informed of any changes. The amended conditions are deemed to be accepted if the user raises no objection within a period of four weeks.

13. Termination/deletion of the customer account

Users can delete their account if they no longer owe any payments. Following prior notification, NAH.SH GmbH may temporarily or permanently block, or completely delete, a customer account in the event of violations of these GTC or in the event of improper use. Such notification will be made to the email address stored in the customer’s account.

14. Limitation of claims

Claims arising from the transport contract and from the use of the NAHSHUTTLE app shall lapse in accordance with the statutory provisions. The regular limitation period is three years and begins at the end of the year in which the claim arose.

15. Choice of law and place of jurisdiction

These GTC are subject to German law. The place of jurisdiction is Kiel.

B: Technical Terms of Use for the NAHSHUTTLE app

1. Purpose of the NAHSHUTTLE app

The NAHSHUTTLE app is exclusively intended for the booking of trips within the scope of the on-demand offer and ALFA transport. Any use beyond this is not permitted.

2. Prohibition of automated access and data extraction

The content and functions of the NAHSHUTTLE app may only be used via the provided user interface. Any automated query, data extraction or other misuse that goes beyond the intended functions is prohibited. Any violations can lead to blocking of access and legal action.

3. Security and protection against misuse

Users are obliged to treat their access data confidentially and to protect it from unauthorized access. NAH.SH GmbH must be informed immediately in the event of suspected misuse or security breaches.

4. Updates and availability

NAH.SH GmbH reserves the right to update, alter or discontinue the NAHSHUTTLE app at any time. There is no entitlement to a certain availability or functionality of the NAHSHUTTLE app.

5. Liability for technical restrictions

NAH.SH GmbH assumes no liability for the error-free functioning of the NAHSHUTTLE app on all end devices. Liability for technical faults, force majeure or failures caused by third parties is excluded, unless this is due to intent or gross negligence.

6. Blocking in the event of misuse

NAH.SH GmbH may temporarily or permanently block user accounts in the event of violations of these Terms of Use or in the event of improper use of the NAHSHUTTLE app.
